1. AGREEMENT TO OUR LEGAL TERMS
These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and w3company co., ltd (“Company,”“we,”“us,”“our”), concerning your access to and use of the Moji mobile application and any other related services (collectively, the “Services”).
By accessing or using our Services, you agree that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Our Privacy Policy, located at https://moji.cool/privacy, is incorporated by reference into these Terms. Please review it carefully to understand how we collect, use, and share your information, including details on international data transfers.
We reserve the right to make changes to these Terms at any time. We will alert you about any changes by updating the “Last updated” date of these Terms. Your continued use of the Services after such changes will constitute your acceptance of the new Terms.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
2. YOUR ACCOUNT
To use our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. We reserve the right to reclaim usernames or terminate accounts if we believe it is appropriate.
3. THE SERVICES
3.1. License to Use the Services
We grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Services. This license is for the sole purpose of letting you use and enjoy the Service’s benefits as intended by us and permitted by these Terms.
3.2. Prohibited Activities
You agree not to use the Services for any purpose that is illegal or prohibited by these Terms. Prohibited activities include, but are not limited to:
- Systematic retrieval of data or other content from the Services to create a collection or database without our written permission.
- Any automated use of the system, such as using scripts, bots, or data mining tools.
- Interfering with, disrupting, or creating an undue burden on the Services or the networks connected to the Services.
- Attempting to impersonate another user or person.
- Harassing, abusing, or harming another person.
- Using the Services in a way that would violate any applicable law or regulation.
- Reverse engineering, decompiling, or otherwise attempting to discover the source code of the Services.
4. CONTENT AND INTELLECTUAL PROPERTY
4.1. Our Content
All content on the Services, including source code, databases, functionality, software, designs, text, and graphics (our “Content”), as well as the trademarks and logos (“Marks”), are owned by or licensed to us and are protected by copyright and trademark laws. Our Content is provided for your information and personal, non-commercial use only.
4.2. Your Content and License Grant
You are solely responsible for the content you create, upload, post, or send through the Services (“Your Content”). You retain ownership of Your Content. However, you grant us a worldwide, transferable, sub-licensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute Your Content.
This license is strictly limited to the purpose of operating, developing, providing, promoting, and improving the Services.
This includes our right to use Your Content (such as anonymized or pseudonymized metadata, aggregated logs, and interaction patterns) to train our machine learning models for service improvement, safety features, and personalized matching recommendations (profiling). As stated in our Privacy Policy, you have the right to opt-out of this profiling at any time.
5. VOICE AND VIDEO CALLS
Moji provides voice and video calling features (“Call Features”). By using these features, you agree to the following:
- Data Processing: To establish and maintain calls, we process necessary technical metadata as further described in our Privacy Policy.
- Security: Calls are transmitted through encrypted channels (e.g., using TLS - Transport Layer Security). However, for the purpose of enabling safety features like screen capture detection, calls are routed through our servers and are not end-to-end encrypted.
- Screen Capture Prevention: To protect user privacy, we automatically detect and may block screen capture or recording attempts during video calls. If a recording is attempted, your video feed may turn black, and the other user may be notified.
- Technology Limitation Disclaimer: While we strive to prevent unauthorized screen capture using available technologies, we cannot guarantee that all screen capture or recording methods (including external cameras or third-party software) will be completely blocked or detected. You acknowledge and agree that we are not liable for any failure to prevent such actions by other users.
- User Conduct: You must not misuse the Call Features for harassment, abuse, or any illegal purpose, and you agree not to record calls without permission.
6. PURCHASES AND PAYMENTS
We may offer products and services for purchase (“In-App Purchases”). If you choose to make an In-App Purchase, you agree to our pricing and payment terms.
7. REFUND POLICY
Generally, all charges for purchases are non-refundable. We may make an exception if required by applicable consumer protection laws in your jurisdiction. For subscribers residing in the EU, European Economic Area, or the Republic of Korea, you may be entitled to a refund in accordance with local law.
8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
9. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by the laws of South Korea, without regard to its conflict of law principles.
To expedite resolution, you and we agree to first attempt to negotiate any dispute informally for at least thirty (30) days. If informal negotiations are unsuccessful, you and we agree that any legal dispute arising in connection with these Terms shall be resolved exclusively in the courts of Seoul, South Korea.
Class Action Waiver: Where permitted under applicable law, you and the Company agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
10. MISCELLANEOUS
These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Services. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver. If any provision of these Terms is held to be invalid, the remaining provisions will continue in full force and effect.
