Purpose of use:

We use and store your information as part of our services for the following purposes:

  • To create a public user profile for you on Moji;
  • To provide a curated community, where access is restricted to members only. We take best efforts to prevent abuse and ban offenders, as soon as we are made aware;
  • To send information relevant to the service (e.g. via email) or push notification (e.g. updates on your membership status, missed calls/messages, new followers);
  • To target ads in the app (this can be turned off in settings);
  • To find Moji partners nearby;
  • To understand how Moji is used and optimize the service;
  • To help keep our community safe, friendly and accountable in both one-on-one chats, parties and group chats;
  • For corresponding with you;
  • For processing contracts with you;
  • For advertising purposes such as the dispatch of our newsletter; On quality assurance and statistics;
  • For your participation in our surveys;
  • To consider your application for membership and for community moderation; In order to improve our service.

How we collect information:

Information you give us directly.

  • Registration information. When you sign up to use the app, you provide us with basic information like your phone number, age, country, and gender.
  • Profile information. When you create a profile on the app, you provide us with information such as profile pictures, name (first and/or last), and any other information you choose to provide.
  • Messages. When you send or receive a message through the app, we collect the contents of the message, any attachments to the message (including, for example, voice messages and photos), and information about the message (such as who you are communicating with).
  • Voice and Video Calls. We do not record or store the content of your audio or video calls. When you use our call features, we collect the necessary metadata to connect the call and ensure its quality and security. This includes the User IDs of participants, call timestamps (start, end, duration), call logs (e.g., missed or answered calls), and technical information required to establish the connection, such as IP addresses and network data. We also log screen capture or recording attempts for safety purposes.
  • Moji communications. When you reach out to us (through, for example, an in-app report or email), we collect and store the contents and details of that communication, including things like date, time, method of communication, and resolution (if applicable).
  • Location Information. When you use our services we may collect information about your location. With your permission, we may also collect information about your precise location that includes methods such as GPS signals.
  • Polls, surveys, and questionnaires. When you voluntarily respond to polls, surveys, and questionnaires, we receive the contents of your responses and any other information you provide, such as your address and basic demographic information.

Information we collect when you use our Services.

  • Log and data usage information. We collect information about your activity on the Services and how you use the Services, such as the date and time you send a message, who you chat with, your internet protocol (“IP”) address, and how you use third-party websites or services accessed through the app.
  • Device and browser information. We collect information from and about the device you use to access our Services.
  • Location information. We use your IP address to infer your general location when you use the Services.

Information we get from Third Parties.

  • We may receive information about you from third parties, including third parties that integrate with the Services or that provide services to us. This may include information such as log and data usage information collected from our Services or other online services, device and browser information, location information, and information collected through cookies or other similar technologies.

How we use the information:

We use the information we collect to:

  • Provide, maintain, improve, and enhance the Services. We use information we collect about you to provide the Services you request from us and to provide the functionality of the app and the features you choose to use.
  • Personalize your experience on the Services. For example, we use the information we collect to personalize content and make suggestions that are relevant to you.
  • Understand and analyze how you use the Services. We aim to continuously improve our offerings to bring you the best way to make meaningful connections. Accordingly, we are continuously analyzing how users access and use the app and its features in order to improve existing Services and develop new ones. Our analysis of how you use the app can help us do things like evaluate the popularity and functionality of certain features, identify and fix potential bugs, and understand what our users want.
  • Communicate with you. The information we collect lets us respond to your comments and questions or otherwise provide customer support, and keep you updated on other information such as Moji’s latest product announcements, software updates, and upcoming events.
  • Enable social functionality. We use the information we collect to support the social functionality of the Services, including to allow you to post content on third party services, such as social media networks.
  • Promote safety and security. We use information to find and prevent fraud and promote trust and safety on the Services. For example, we may automatically scan messages for inappropriate content (like spam, harassment, or illegal content) to protect the safety and integrity of our Services and users. You have the right to object to this automated scanning, which you can exercise through our Contact Form. In such cases, we will review your objection, though exceptions may apply to ensure the ongoing safety of the service.
  • Operate Voice and Video Calls. We use the call metadata described above to connect you with other users, ensure call stability, diagnose technical issues, and improve our call services. We also use this data to enable our safety features, such as screen capture detection. If a user attempts to record a video call, their own video feed will turn black, and the other participant may be notified. We log that a screen capture attempt occurred for security auditing but do not store the captured content itself. You also have the right to object to the processing of your call metadata. You can exercise this right through our Contact Form, though exceptions may apply if the processing is essential for service stability and security.
  • Use of AI and Machine Learning. To improve service quality, enhance safety features, and provide optimal matching recommendations, we use metadata (e.g., interaction logs, device/network information, location information) and anonymized or pseudonymized data to train our machine learning models. We process this data based on the necessity to perform our contract with you (Art. 6(1)(b) GDPR) by providing personalized matching recommendations, and based on our legitimate interests (Art. 6(1)(f) GDPR) in improving and securing our service. The content of your messages and calls is not used for advertising purposes; for safety and service improvement, it is only processed in an anonymized or aggregated form. You have the right to opt-out of profiling for matching recommendations at any time by contacting us through our Contact Form, and your ability to use the basic features of our service will not be affected.
  • Compliance purposes. We may use the information we collect to enforce our Terms of Service, Community Guidelines, and other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.
  • Deliver ads and other sponsored content. We use the information we collect, including information about your interests, actions and connections, to select, personalize, and deliver ads, offers and other sponsored content.
  • Send you push notifications. We may use the information we collect to send you push notifications.
  • Other purposes. We may also use the information we collect for other purposes for which we provide notice at the time the information is collected.

How we share the information:

  • Other users. Our Service is a social service intended to help you make new friends and interact with them. Please be aware that your profile information will always be viewable by other users. You may edit your profile information within the app through your profile settings. We are not responsible for other users’ use of available information, so you should carefully consider whether and what to include in your profile or otherwise share through the Services.
  • Our service providers. We share the information we collect with third-party service providers that help operate our business. Examples include suppliers who host our data, provide customer service, or support our call delivery infrastructure.
  • Advertising Partners and Third-Party Data. To provide our services, often for free, we partner with third-party advertising networks and their partners (e.g., Google AdMob, Meta, Pangle, AppLovin, Liftoff, Unity Ads, ironSource, and others) to display advertisements within our app.
    To make these ads relevant to you, we may allow our partners to collect certain information from your device, but only with your explicit consent, which we manage through a Consent Management Platform (CMP). This information may include your device's advertising identifier (IDFA for iOS, GAID for Android), IP address, device information (such as model and operating system), general location data (like country or city), and information about your interactions within our app. Our partners may use this information for personalized advertising, ad measurement, and to prevent fraud.
    This process may involve real-time bidding where our partners share this data with other advertising demand partners to find the most relevant ad for you. We do not share sensitive personal information like your name, phone number, or direct messages for advertising purposes.
    You have full control over this data sharing. You can manage your preferences, view our list of advertising partners, and withdraw your consent at any time through the privacy settings within our app. This list of partners is reviewed and updated periodically. If you do not provide consent, you may still see ads, but they will not be personalized based on your data. We encourage you to review the privacy policies of our partners to understand how they handle your data.
  • To protect Moji and its users, or for legal purposes. We may access, preserve, and disclose your information, including limited call metadata, if we believe doing so is required or appropriate to:
    1. detect, prevent or address fraud or other illegal activity
    2. respond to your requests;
    3. comply with law enforcement requests and legal process, such as subpoenas, warrants, production orders, or similar instruments; or
    4. protect your, our, or others’ rights, property, or safety, including when there is an emergency involving potential harm, loss of security or serious injury to people or threats of such emergencies. For the avoidance of doubt, we may disclose your information if you post any objectionable content on or through the Services.
  • Merger, financing or sale. We may share your information with service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a merger, financing, acquisition, dissolution transaction, bankruptcy or proceeding involving the sale, transfer, or divestiture of all or a portion of our business or assets.
  • Consent. We may also share your information with your permission.

Data Retention

We retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. The retention periods vary depending on the type of information and the purposes for which we use it.

  • Account Information: We keep your profile and other account data for as long as your account is active to provide you with our services.
  • After Account Deletion: When you request to delete your account, we will initiate the deletion process after a grace period of 30 days. This period allows for account recovery in case of accidental deletion and helps us prevent fraud and abuse. After this period, your data, including any associated call metadata, is permanently deleted or anonymized.
  • Legal Obligations: Even after you delete your account, we may retain certain information for a longer period, generally up to 7 years, or as otherwise required by applicable local laws. This retention is necessary for purposes such as tax, accounting, and to comply with other legal obligations or to resolve legal claims. This data is kept in a secure and isolated environment and is used only for these specified purposes.
  • Anonymized Data: We may retain anonymized information indefinitely for statistical and service improvement purposes, as this information no longer identifies you as an individual.

International Data Transfers

Moji is a global service. To provide our service, we may transfer and process your information on servers located in South Korea and other countries outside of where you live. When we transfer your data, we take steps to ensure it is protected. This includes data necessary for the operation of our service, such as technical metadata to connect calls and data used for service improvement and machine learning purposes.

Specifically for transfers of personal data from the European Economic Area (EEA) to South Korea, we rely on the adequacy decision granted by the European Commission to the Republic of Korea, which recognizes that South Korea provides an adequate level of data protection. For transfers to other countries, we use Standard Contractual Clauses and other appropriate legal mechanisms to ensure your rights are protected.

Your Rights Regarding Your Personal Data

As a Moji user, you have certain rights regarding your personal data. If you are a resident of the European Economic Area (EEA), these rights are protected under the GDPR. We are committed to upholding these rights for all our users.

  • The right to access – You have the right to request copies of your personal data.
  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure (‘right to be forgotten’) – You have the right to request that we erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions, particularly for direct marketing purposes.
  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
  • The right to withdraw consent – You can withdraw your consent to the processing and use of your data at any time.

Legal basis:

Your U.S. Privacy Rights

This section applies to residents of certain U.S. states with comprehensive privacy laws, such as California (CCPA), Virginia (VCDPA), Colorado (CPA), and others.

We do not "sell" your personal information or "share" it for cross-context behavioral advertising, as those terms are defined under applicable U.S. state privacy laws. This means we do not exchange your personal information with third parties for monetary or other valuable consideration.

Depending on your state of residence, you may have the right to:

  • Know what personal information we have collected about you.
  • Request the deletion of your personal information.
  • Correct inaccurate personal information.
  • Opt-out of the processing of your data for targeted advertising (Note: you can control ad targeting in the app's settings).
  • Not receive discriminatory treatment for exercising your privacy rights.

  • With regard to data communicated in forms, etc. with your consent, Art. 6(1) (a) GDPR;
  • With regard to services you use for the performance of a contract, Art. 6(1) (b) GDPR;
  • The fulfilment of legal obligations, Art. 6(1) (c) GDPR;
  • Otherwise, with particular regard to statistical data and online identifiers based on legitimate interests, Art 6(1)(f) GDPR (see below).

When we process your data based on legitimate interests (Art. 6(1)(f) GDPR), we pursue the following purposes:

  • Providing, maintaining, and improving our service;
  • Protecting our service and users from misuse and ensuring security;
  • Performing statistical analysis to understand how our service is used.

Children privacy:

Our services are restricted to individuals who are 18 years of age or older. We do not permit individuals under the age of 18 on our platform. If you suspect that a user is under the age of 18, please use the reporting mechanism available on the service.

Changes:

Because we’re always looking for new and innovative ways to help you build meaningful connections and strive on making sure explanations about our data practices remain up to date, this policy may change over time. We will notify you before any material changes take effect so that you have time to review the changes.
